Dish Network Taking TiVo to Supreme Court
Satellite-TV Operator Appeals Ruling in Favor of DVR Vendor to High Court

Satellite operator Dish Network said it is going to the Supreme Court to appeal a lower-court decision granting TiVo $94 million in damages in a patent fight over Dish’s digital-video recorder.

That came after a Federal Appeals Court denied its appeal last month for a rehearing.
Dish said Friday that it was "disappointed" in the court's denial of the petition for rehearing, but it will not have any affect on its current or future customers, adding that it was already employing next-generation DVR software in its set-top boxes that does not infringe on the patent at issue.
Nonetheless, "We intend to appeal the Federal Circuit’s ruling to the United States Supreme Court," the company said.

What I would really like to see from the cable/satellite providers is
CHOICE PROGRAMMING. That is... I only want to receive 10 channels,
or 20 or whatever. I don''t want to subsidize any funky channels. I
don''t want to feel like I''m being made to pay for others. For example,

has a bunch of crap I''ll never watch. In the package I have now, I am
paying for Channels I don''t want and not getting channels I want, but I
can''t get channels I want unless I pay more and get even more
channels I don''t want. OK that said, here''s what I want, and what
benefits I think occur from the change. I want to be able to select say
20 channels. For me these include Discovery, History, BBC, Fox News,
The learning Channel, HGTV, A couple of sports channels, CSPAN and a
couple of others. I am willing to pay per channel. Just don''t make me
pay for channels I won''t use or generally object to. The benefits are
that the free market will decide which channels get funded, and which
ones die without the need for Nielsen ratings or anything like that.
The average American consumer will drive the change. For new
channels to break into the market, they will have to be funded by
normal means, and given to consumers to try for free for some period
of time. But ultimately, if there is some social driver behind their
existence, then they will have to stand on their own two feet. Let the
consumers choose. Unlike the Gov''t shoving digital tv down our
throats.

Mr.Tom Rogers want's companies to pay for the use of digital video recorders, Dish Network and cable tv. Then they must pay. Fortunely, Tom Roger's of TIVO can not sue Sony or DVD recorder unit's, which has time wrap. If TIVO can, then Time Wrap belong to TIVO and so does digital video recording.
